Fotve Privacy Policy
This policy explains what data Fotve processes, what it is for, how we protect it, and what rights the user has.
1. Who processes the data
Within the framework of the Fotve service, personal data is processed in accordance with the Law of Ukraine "On Personal Data Protection", other acts of Ukrainian legislation and, if applicable, the principles of the GDPR for users from the European Union.
2. What data we may process
We only process data that is necessary for the operation of the service, payment, security, user support and compliance with legal obligations.
- Account data: email, name, interface language, profile settings, subscription status.
- Authorization data: technical tokens of the session, Google authorization information, if you use it.
- Payment data: amount, tariff, payment status, transaction ID. Full card details are processed by the payment provider, we do not store them.
- User content: uploaded photos, images, prompts, editing results, projects, layers, and exported files.
- Technical data: IP address, device type, browser, operating system, error logs, date and time of action, cookies and similar technologies.
- Communications: contacting support, correspondence, reporting errors or payment.
3. Photos, faces, and uploaded files
Photos may contain personal data, including images of a face, body, objects, documents, locations, or other people. We do not use uploaded photos to establish the user's identity unless it is expressly necessary to provide the feature that the user has triggered.
For AI tools, Fotve transmits the user-selected photos, images containing faces, prompts, masks, tool settings, and generated results to Fotve servers and AI and technical processing services only to perform the specific operation that the user starts in the app or on the website.
Fotve does not collect biometric face templates, Face ID data, face geometry, face landmarks, or face recognition identifiers, and does not use such data to identify, authenticate, track the user, or train third-party AI models.
You are responsible for having the right to upload and edit the relevant images, as well as obtaining the necessary consents of the persons depicted in the photo.
4. What we use data for
The data is used to create an account, authorize, provide access to subscriptions, launch AI tools, save projects, process payments, support users, prevent fraud, improve the service, and comply with legal requirements.
- Fulfillment of the contract with the user: editor, generation, subscription, saving projects.
- User consent: individual integrations, marketing messages or cookies, if such consent is required.
- Legitimate interest: security, analytics, stability improvement, protection against abuse.
- Legal obligation: tax, accounting, payment and other legal requirements.
6. Storage periods
Account data is stored for the lifetime of the account and for a reasonable period after its deletion, if necessary for security, dispute resolution or compliance with the law. Payment and accounting data are stored for the periods provided for by law.
Uploaded files, projects and results can be stored in the user's account until the user deletes them, the storage period expires, technical cleanup occurs, or the account is terminated. Temporary files can be deleted automatically.
Temporary copies of photos, prompts, and files used for AI processing are deleted after the technical operation is completed unless further storage is required for security, error resolution, or legal compliance. Guest projects are stored for up to 2 days, projects without an active subscription for up to 90 days, and active subscriber projects until the user deletes the project, deletes the account, or the applicable retention period ends.
7. Payments and returns
To process payments, we store information about the tariff, amount, date, status and technical identifier of the transaction. The full bank card details are processed by the payment provider and are not stored by Fotve.
If access to the digital service was provided after payment, no refund is usually given. We can consider the appeal individually in case of a technical error, double write-off or failure to provide paid access due to our fault.
8. Data protection
We apply technical and organizational security measures, including access controls, rights restrictions, logging, HTTPS connections, and isolation of technical processes where practicable.
No online service can guarantee absolute security. The user must independently protect access to his email, password, devices and account.
9. User rights
You can contact us to obtain information about the processing of your personal data, to request the rectification of inaccurate data, to delete your account or individual data, to restrict processing, to object to individual processing or to withdraw consent if the processing is based on consent.
We may ask you to verify the identity of the applicant before completing the request. Some data may not be deleted immediately if its storage is necessary to comply with the law, defend rights or resolve disputes.
11. Children
Fotve is not intended for independent use by children under the age from which they can independently enter into contracts or consent to data processing in accordance with applicable law. If you believe that a child has provided us with personal data without proper consent, please contact support.
12. Policy changes
We may update this Privacy Policy. The new version comes into force from the moment of publication on the site, unless otherwise indicated in the text of the update. Continuing to use Fotve after an update means familiarizing yourself with the new edition.
