Fotve Terms of Use

1. Acceptance of the terms

These Terms of Use are a public offer and an adhesion agreement within the meaning of the legislation of Ukraine. By using the site, registering an account, paying for a subscription, or launching any Fotve tool, you confirm that you have read, understood, and accept these terms.

If you do not agree to the terms, do not use the service or make a payment.

2. Service Description

Fotve is an online service for editing images, working with layers, removing backgrounds, improving quality, generating images, applying AI filters, changing photo elements, and creating visuals.

The service can use its own infrastructure, third-party payment, cloud, analytics, and AI providers. Service features may change, update, temporarily disable, or be replaced without separate notice if necessary for the safety, stability, or development of the product.

3. Account and access

Some features may require registration or authorization. You are responsible for keeping your account details up to date, password confidentiality, and all activities done through your account.

We may restrict or terminate access to an account if there are signs of fraud, violation of these terms, illegal use of the service, attempts to circumvent limits, or damage to Fotve's infrastructure.

4. Subscriptions, Tariffs and Payment

Fotve operates on a paid-access model for some or all service features. Payments are processed through connected payment providers. Access is activated after successful payment or payment confirmation.

As of this version, there are two paid monthly tariffs: Fotve Start for $9 per month and Fotve Full Access for $19.99 every 4 weeks, or the equivalent amount in another currency if checkout is displayed outside USD.

Users may receive a 7-day trial version to evaluate the service. The trial is a trial access period and is not listed or treated as a separate paid tariff.

Prices may change. A new price applies to future payments and does not change an already paid access period unless expressly stated on the payment page.

• Fotve Start: Fotve access for one month, $9 or equivalent in another currency.
• Fotve Full Access: full Fotve access for one billing period, $19.99 or equivalent in another currency.

5. Cancellations and refunds

Fotve provides a digital service and access to online tools. If, after payment, access to digital functionality was provided or the user began to use paid features, refunds are usually not made.

We can consider a refund request individually if there was a technical payment error, a double charge or paid access was not provided through our fault and the problem cannot be resolved within a reasonable time.

This provision does not limit the rights of the consumer, which cannot be limited by the contract in accordance with the legislation of Ukraine.

6. User Content

You retain the rights to photos, images, texts, prompts, logos, files and other materials that you upload or create on Fotve, unless otherwise implied by law or the rights of third parties.

In order to operate the service, you grant Fotve a non-exclusive technical license to process, upload, store, modify, transmit to technical providers, and display your materials solely for the purpose of providing the features of the service.

You confirm that you have the right to use the uploaded materials, obtained the necessary consents of the persons depicted in the photo, and do not violate the copyright, trademark rights, privacy rights or other rights of third parties.

7. Prohibited Use

You may not use Fotve for any unlawful, fraudulent, discriminatory, defamatory, harmful, or dangerous activity, invasion of privacy, creation of material without necessary rights or consents, circumvention of technical restrictions, automated abuse of the service, or infrastructure interference.

We may remove materials, restrict generations, or block access if we believe that use poses a legal, reputational, technical, or security risk.

8. AI Results and User Responsibility

AI tools can create inaccurate, unwanted, similar to existing work, or unexpected results. Fotve does not guarantee a specific artistic, commercial, legal, or technical result of generation or editing.

You independently check the result before publishing, advertising, selling, printing or other use. You are responsible for the legality of the use of the uploaded and generated materials.

9. Availability of the service

The service is provided on an "as is" and "as available" basis. We are committed to maintaining the stable operation of Fotve, but we do not guarantee uninterrupted access, no errors, compatibility with all devices, or the preservation of every intermediate result.

There may be technical interruptions due to updates, crashes, loads, ISP actions, network failures, force majeure, cyberattacks, or other circumstances beyond our full control.

10. Limitation of Liability

To the maximum extent permitted by law, Fotve, the contractors and technical providers involved shall not be liable for indirect, incidental, special, punitive or consequential damages, loss of profits, goodwill, data, business opportunities, expected result, or damages caused by the use or inability to use the service.

If liability cannot be excluded by law, its total amount is limited to the amount actually paid by you to Fotve during the last 30 calendar days before the event giving rise to the claim, unless another minimum amount of liability is expressly established by mandatory provisions of the legislation of Ukraine.

11. Changes to Terms and Conditions and Law

We may update these Terms. The new version comes into force from the moment of publication on the site, unless otherwise specified in the version itself. Continuing to use the service after the update means accepting the new terms.

The legislation of Ukraine applies to these Terms. Disputes shall be resolved through negotiations, and if no agreement is reached, in accordance with the procedure provided for by the legislation of Ukraine.
